By accessing or using Olanah LLC's mental health software platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our service.

2. Service Description

Olanah LLC provides a HIPAA-compliant software platform designed to facilitate communication and record-keeping for mental health professionals and their clients.

3. User Eligibility

• Therapists must be licensed mental health professionals
• Clients must be at least 18 years old or have parental consent
• Users are responsible for verifying their own eligibility

4. User Accounts

• Users must provide accurate and complete information
• Each user is responsible for maintaining the confidentiality of their account
• Users are liable for all activities under their account
• Olanah LLC reserves the right to suspend or terminate accounts

5. Professional Responsibility

• Therapists are solely responsible for the care and treatment of their clients
• Our platform is a tool to assist professional services, not a replacement for direct care
• Therapists must maintain professional standards of care

6. Confidentiality and Privacy

• All user data is protected in compliance with HIPAA regulations
• Users must not share confidential information outside the platform
• Therapists are responsible for obtaining necessary client consents

7. Prohibited Activities

• No use of the platform for illegal activities
• No harassment, discrimination, or abusive behavior
• No attempting to breach system security
• No sharing of login credentials
• No use of the platform for purposes other than intended mental health services

8. Intellectual Property

• All platform content and design are owned by Olanah LLC
• Users grant a limited, non-exclusive license to use their content for platform operation
• Users retain ownership of their personal and professional data

9. Payment and Billing

• Pricing and payment terms are detailed in our separate pricing agreement
• Payments are processed through Stripe
• Fees are subject to change with 30 days' notice
• No refunds for partial billing periods

10. Limitation of Liability

Olanah LLC is not liable for:

• Any therapeutic outcomes
• Data loss or breaches not directly caused by our negligence
• Indirect, consequential, or punitive damages
• Issues arising from user misuse of the platform

11. Indemnification

Users agree to indemnify Olanah LLC against any claims arising from their use of the platform, including legal fees and expenses.

12. Dispute Resolution

• Any disputes will be resolved under Wisconsin state law
• Binding arbitration in Milwaukee County, Wisconsin
• Individual arbitration, no class action lawsuits

13. Termination

• Users may terminate their account at any time
• Olanah LLC may terminate service for violation of terms
• Data handling will follow our privacy policy upon termination

14. Changes to Terms

We may modify these terms. Continued use of the platform constitutes acceptance of new terms.

15. SMS Communications

By using Olanah, you understand and agree to receive SMS communications:

• We send verification codes via SMS for account security purposes
• Activity reminders and notifications are delivered through SMS
• Message and data rates may apply based on your carrier
• You can opt-out of SMS communications at any time by replying STOP
